Statement by SWAN urging EU to impose stronger sanctions against the Burmese military regime

The Shan Women’s Action Network has consistently called for economic sanctions against the Burmese military regime, and at this crucial time urges the European Union to impose strong new economic sanctions on the regime.

The Shan State is the largest state of Burma, and one of the richest in natural resources. Since the opening up of the economy to foreign investment in 1988, foreign companies have rushed in to invest in our forests, minerals and rivers. Yet the vast majority of our people have seen no benefits from this investment whatsoever. On the contrary, we have seen a massive increase of Burma Army troops to protect these investments, which include vast logging concessions, gem mines, and mega-dams, including on the Salween River. This has led to increased forced relocation, land confiscation, forced labour, extrajudicial killing, torture and systematic rape. Our environment has been ravaged, and food security has plummeted, as have standards of health and education, resulting in an influx of hundreds of thousands of refugees into Thailand.

The international community has recently witnessed the regime’s brutal crackdown on the peaceful demonstrations led by Buddhist monks in Rangoon. In fact, such brutality has been commonplace over the past decades in Shan State, in areas inaccessible to the international media. Countless civilians, including Buddhist monks, have suffered extrajudicial killing and torture at the hands of the regime’s troops. Since the publication of our report “Licence to Rape” in 2002, detailing the rape of 625 women and girls in Shan State, SWAN has been exposing the ongoing use of rape as a weapon of war by the regime. With the continual build-up of Burma Army battalions in Shan State, civilians face the constant threat of violence, and women and girls live in perpetual fear of sexual assault.

It is very clear that foreign investment in Burma at this time means complicity in the military regime’s oppression of our people and exploitation of our resources. We therefore urge the EU to impose strong new economic sanctions on Burma’s military regime. In particular, we call for an international arms embargo.

Faced with the international community’s condemnation of the violent crackdown, even China could not defend the SPDC.
On 26 September, China’s Ambassador to the UN, Wang Guangya, said that China wished to see stability, mutual reconciliation, and progress towards democracy in Burma.[AP (27 Sep 07) UNSC Concerned About Myanmar Crackdown] Premier Wen Jiabao confirmed China’s shift, and expressed hopes that stability, national reconciliation, and democracy will be achieved as soon as possible through peaceful means.[Bloomberg (30 Sep 07) China Backs End to Myanmar Violence; UN Envoy Arrives]On 12 January, China and Russia vetoed a joint US/UK resolution on Burma before the UNSC.[Bangkok Post (13 Jan 07) China, Russia veto UN Burma resolution] Because of the vetoes, the resolution failed even though the final vote was 9 to 3 in favor of adoption.China’s UN Ambassador Wang Guangya acknowledged that there were problems in Burma but did not feel the problems constituted a threat to international peace and security.[New York Times (13 Jan 07) U.S. Rebuke to Myanmar Is Defeated by U.N. On 23 November, China’s Assistant Minister of Commerce Chen Jian granted a debt exemption to the SPDC and established a framework agreement for a preferential loan. According to a Chinese official, the debt cancellation 240 million yuan (US$30 million) and the low interest loan was 300 million yuan (US$38 million).[AP (24 Nov 06) China grants Myanmar partial debt relief] Chen Jian was in the country from 20 November, discussing timber, mining and agricultural cooperation. China can afford to be generous. According to the latest Chinese official statistics, in the first half of 2006, total bilateral trade was up 10.8% from the same period in 2005. รายงานพิเศษจากเจนีวา: ก้าวต่อไปของคณะมนตรีสิทธิมนุษยชนกับสถานการณ์ในพม่า

เมื่ออาทิตย์ที่ผ่านมาคณะมนตรีสิทธิมนุษยชนของสหประชาชาติ (UN Human Rights Council) ได้มีการนัดประชุมวาระพิเศษ (Special Session) ในประเด็นสถานการณ์การละเมิดสิทธิมนุษยชนในพม่าหลังจากได้มีการปราบปรามพระและผู้ชุมนุมที่ออกมาเดินขบวนเรียกร้องประชาธิปไตย

การที่พม่าเข้าไปสู่ในวาระพิเศษนี้นับว่าเป็นความสำเร็จส่วนหนึ่งของขบวนการเรียกร้องเพื่อประชาธิปไตยในพม่า กระบวนการผลักดันนี้เกิดขึ้นโดยที่รัฐบาลโปรตุเกสและสมาชิกของคณะมนตรีสิทธิฯ อีก 17 ประเทศได้เรียกร้องให้ประธานคณะมนตรีสิทธิมนุษยชนตั้งวาระพิเศษนี้ขึ้นมาพร้อมกับการเรียกร้องจากองค์กรสิทธิมนุษยชนทั่วโลก เพื่อนำสถานการณ์ในประเทศที่ละเมิดสิทธิมนุษยชนของประชาชนตัวเอง จนทำให้มีผู้ลี้ภัยมากกว่าล้านคนทั่วโลก[i] และผู้ผลัดถิ่นในประเทศ (Internally Displaced Persons)[ii] หลายร้อยล้านคน จากการละเมิดสิทธิมนุษยชนขนาดหนักให้เป็นวาระสากล และเป็นการเกิดขึ้นครั้งแรกที่นำประเด็นสิทธิมนุษยชนในเอเชียเข้าไปในวาระพิเศษเนื่องจากที่ผ่านมาคล้ายกับว่ากรณีสิทธิมนุษยชนในเอเชียถูกปลีกออกไป เนื่องจากในวาระที่ผ่านมาได้มีการพิจารณาเพียงแค่กรณีซูดาน เลบานอน และปาเลสไตน์

จากการประชุมหนึ่งวันเต็มนี้เราได้เห็นข้อแถลง (intervention) ของรัฐบาลหลายประเทศที่เป็นไปในแง่บวกในการตอบรับกับสถานการณ์การปราบปรามประชาชน ประเทศต่าง ๆ ในสหภาพยุโรปได้มีจุดยืนที่ร่วมกัน เช่น ประนามความรุนแรงที่เกิดขึ้นโดยรัฐบาลเผด็จการทหาร เรียกร้องให้มีการนำผู้กระทำผิดมาลงโทษตามกฎหมาย เรียกร้องให้รัฐบาลพม่ายอมรับให้ศาสตราจารย์พอลโล เซอร์จีโอ พินเฮโร (Paulo Sergio Pinheiro) ผู้ตรวจสอบพิเศษกรณีสิทธิมนุษยชนในประเทศพม่าสามารถเข้าไปตรวจสอบการละเมิดสิทธิมนุษยชนได้ ซึ่งศจ.พอลโลในฐานะเป็นผู้ตรวจสอบพิเศษที่กรรมาธิการสิทธิมนุษยชน (Commission of Human Rights) ได้แต่งตั้งขึ้นมาไม่สามารถเข้าไปพม่าได้ตั้งแต่ปี ค.ศ. 2003 เนื่องจากรัฐบาลทหารพม่าปฎิเสธที่จะให้วีซ่า – ซึ่งนับว่าเป็นการแสดงตัวเป็นปฎิปักษ์กับกลไกสิทธิมนุษยชนระหว่างประเทศ

ข้อแถลงที่มีพลังมากที่สุดอันหนึ่ง คือ โดยผู้แทนถาวรประจำสหประชาชาติของประเทศสวีเดน ซึ่งได้อยู่ในร่างกุ้งในเวลาที่รัฐบาลทหารได้ใช้ความรุนแรงกับประชาชนได้ให้ข้อมูลชัดเจนกับคณะมนตรีฯ เกี่ยวกับการปราบและสลายการชุมนุมกับผู้ชุมนุมและพระสงฆ์อย่างทารุณ และรวมถึงเหตุการณ์ที่ประชาชนถูกไล่ยิงในตรอกกลางเมืองโดยเจ้าหน้าที่ทหาร

ฑูตของประเทศญี่ปุ่นได้กล่าวว่าการสังหารประชาชนเป็นเหตุการณ์ที่ทารุณและเรียกร้องให้รัฐบาลพม่าหยุดการใช้กองกำลังที่กดขี่ประชาชน ในขณะที่ประเทศที่อยู่ห่างไกลเหตุการณ์อย่างมอริเชียส (Mauritius) แสดงจุดยืนว่า “ประเทศที่เป็นประชาธิปไตยจะไม่ยอมที่จะเห็นรัฐบาลใด ๆ สังหารประชาชนที่เรียกร้องเพียงแค่เสรีภาพและความยุติธรรม”

แม้ว่าการแถลงจากประเทศต่าง ๆ มากกว่า 50 ประเทศประนามการสลายการชุมนุมของรัฐบาลเป็นปรากฎการณ์ที่ไม่เคยเกิดขึ้นและแสดงให้เห็นว่าประชาคมโลกกำลังติดตามสถานการณ์ในพม่าอย่างต่อเนื่อง แต่อย่างไรก็ตามผลที่ได้ออกมาจากวาระพิเศษหรือมติ (resolution) ของคณะมนตรีสิทธิมนุษยชนฯ นี้ยังต่ำกว่าความคาดหวังของนักกิจกรรมพม่าและองค์กรสิทธิมนุษยชนมาก เนื่องจากมติของคณะมนตรีฯ ไม่ได้มีประเด็นที่เป็นรูปธรรมในการหยุดความรุนแรงโดยรัฐบาลพม่า

มตินี้เพียงพูดถึงประเด็นเพียงแค่การประนามการกระทำของเหล่านายพลทหาร ซึ่งเป็นประเด็นที่ไม่มีความเข้มแข็งเนื่องจากไม่ได้มีการพูดถึงกระบวนการที่จะนำไปสู่การนำคนเหล่านี้มาลงโทษเลย ซึ่งมติเช่นนี้คล้ายคลึงกับมติเก่า ๆ ที่เคยออกโดยคณะกรรมาธิการสิทธิมนุษยชนแห่งสหประชาชาติ (UN Commission on Human Rights) ซึ่งเป็นกลไกสิทธิมนุษยชนของโลกในอดีตก่อนมีการก่อตั้งคณะมนตรีสิทธิมนุษยชนในปี ค.ศ. 2006

แม้ว่าองค์กรสิทธิมนุษยชนระดับภูมิภาคและระดับสากลได้มีการเรียกร้องให้มีการตั้งคณะกรรมการตรวจสอบการละเมิดสิทธิมนุษยชนที่ประกอบไปด้วยผู้รายงานพิเศษจากหลากหลายประเด็น (Thematic-based Special Procedures) ในการเข้าไปตรวจสอบสถานการณ์ และทีมอิสระติดตามสถานการณ์ที่จะถูกตั้งขึ้นภายในประเทศพม่าเพื่อค่อยติดตามสถานการณ์ละเมิดสิทธิมนุษยชน แต่มตินี้เพียงแต่พูดถึงการเข้าไปตรวจสอบสถานการณ์โดยผู้รายงานพิเศษ

ในมุมมองของเรา แม้ว่ามติของคณะมนตรีสิทธิมนุษยชนนี้จะไม่ใช่สิ่งที่องค์กรสิทธิมนุษยชนหวังจะให้เป็น แต่ประเด็นที่เรียกให้ “ผู้ตรวจสอบพิเศษเข้าไปประเมินสถานการณ์ในประเทศพม่า” ก็ยังเป็นประเด็นที่สำคัญในการพัฒนาสิทธิมนุษยชนของประเทศพม่า ดังนั้นสมาชิกของคณะมนตรีสิทธิมนุษยชนในเอเชีย และในอาเซียนซึ่งประกอบไปด้วยประเทศฟิลิปปินส์และอินโดนีเซียต้องร่วมกันกดดันให้รัฐบาลทหารพม่ายอมรับให้ ศจ.พินเฮโรเข้าไปในพม่า อาเซียนไม่สามารถอ้างถึงนโยบาย “หลักการไม่แทรกแซง” (Non-interference policy) ในขณะที่ประเทศเพื่อนบ้านของอาเซียนกำลังเข่นฆ่าประชาชนที่ต่อสู้มือเปล่าเพื่อประชาธิปไตย

ล่าสุดนี้ได้มีรายงานออกมามากมายเกี่ยวกับความรุนแรงที่ยังคงเกิดขึ้นหลังจากการปราบผู้ชุมนุม เราได้เห็นรายงานอย่างไม่เป็นทางการเกี่ยวกับยอดผู้เสียชีวิตที่มีมากกว่า 1,000 คนซึ่งขัดกับรายงานของรัฐบาลทหารอย่างสิ้นเชิง[iii]

การเข้าไปในพม่าของ ศจ.พินเฮโรดังนั้นจะมีความสำคัญมากเพราะตอนนี้ได้มีข้อมูลเกี่ยวกับนโยบายการเข้าไปจับกุมประชาชนกลางดึกจากบ้านหลังหนึ่งสู่บ้านอีกหลังหนึ่ง โดยมีเป้าหมายคือประชาชนที่ได้ออกมาชุมนุมในปลายเดือนที่ผ่านมา การให้ปากคำของนายพันของรัฐบาลทหารพม่าที่กำลังลี้ภัยไปประเทศนอร์เวย์ที่กล่าวว่าประชาชนและพระสงฆ์ได้ถูกฆ่าจำนวนมากก็แสดงให้เห็นถึงความโหดร้ายของรัฐบาลพม่าให้ประชาคมโลกได้เห็นอีกครั้ง[iv] นอกจากนี้กลุ่มขบวนการเรียกร้องประชาธิปไตยของชาวพม่าผลัดถิ่นก็ได้ตั้งข้อสงสัยเกี่ยวกับการหายตัวไปของพระสงฆ์จากท้องถนนหลังจากการปราบผู้ชุมนุมซึ่งกำลังสร้างข้อวิตกหลายอย่าง ดังนั้นการเข้าไปตรวจสอบสถานการณ์สิทธิมนุษยชนโดยผู้รายงานพิเศษจึงเป็นส่วนสำคัญในการอุดช่องว่างเกี่ยวกับสถานการณ์ที่เกิดขึ้นจริงในประเทศพม่า

ประชาชนพม่าได้เสียสละแต่ต่อสู้เพื่อประชาธิปไตยและสิทธิมนุษยชนอย่างมากเป็นระยะเวลาหลายสิบปี ประชาคมโลกโดยเฉพาะสมาชิกของคณะมนตรีสิทธิมนุษยชนของสหประชาชาติไม่ควรทำให้พวกเขาผิดหวังหรือรอมากเกินไปกว่านี้

ภูมิหลัง

คณะมนตรีสิทธิมนุษยชนแห่งสหประชาชาติ (UN Human Rights Council) เป็นกลไกทางด้านสิทธิมนุษยชนขององค์การสหประชาชาติที่ถูกก่อตั้งขึ้นในปี ค.ศ. 2006 แทนที่คณะกรรมาธิการสิทธิมนุษยชนแห่งสหประชาชาติ (UN Commission for Human Rights)

คณะมนตรีสิทธิฯ ประกอบด้วยสมาชิก 47 ประเทศที่ได้รับเลือกจากประเทศสมาชิก การปฎิรูปโครงสร้างจากคณะกรรมธิการเป็นคณะมนตรีฯ นี้ทำให้กลไกสิทธิมนุษยชนเป็นเอกภาพมากขึ้นเนื่องจากในอดีตประเด็นสิทธิมนุษยชนแม้ว่าเป็นหนึ่งในสามเป้าหมายของการก่อตั้งสหประชาชาติ คือ สิทธิมนุษยชน สันติภาพ และการพัฒนา (Human Rights, Peace, and Development) ไม่ได้รับความสำคัญ เนื่องจากคณะกรรมาธิการฯ ต้องรายงานต่อคณะมนตรีเศรษฐกิจและสังคมแห่งสหประชาชาติ (UN Economic and Social Council) แต่หลังจากการปฎิรูปเป็นคณะมนตรีสิทธิฯ นี้ทำให้รายงานโดยตรงต่อสมัชชาใหญ่ของสหประชาชาติ (UN General Assembly) ได้เลย นอกจากนี้ยังมีการสามารถเรียกประชุมวาระพิเศษ (Special Session) ได้ทันที เช่น เดียวกับที่มีการเรียกประชุมวาระประเทศพม่าเพื่อเป็นการตอบสนองกับสถานการณ์การละเมิดสิทธิมนุษยชนของประเทศใดประเทศหนึ่งให้อย่างทันท่วงที นอกจากนี้ยังมีกระบวนการใหม่ซึ่งเรียกว่ากระบวนการตรวจสอบสถานการณ์สิทธิมนุษยชน (Universal Periodic Reviews) โดยที่ทุกประเทศต้องผ่านการตรวจสอบนี้

ส่วนผู้รายงานพิเศษของสหประชาชาติ (UN Special Rapporteur) เป็นกลไกที่ถูกก่อตั้งโดยคณะกรรมกาธิการสิทธิมนุษยชนฯ ในการตรวจสอบ ติดตาม ให้ข้อแนะนำ และเผยแพร่รายงานกรณีสิทธิมนุษยชน โดยปัจจุบันนี้มีผู้รายงานพิเศษจำนวน 38 ตำแหน่ง ประกอบไปด้วยผู้รายงานพิเศษติดตามสถานการณ์ในประเทศ (Country-specific Special Procedures) 10 ประเทศ และ ผู้รายงานพิเศษติดตามสถานการณ์ตามประเด็น (Thematic-specific Special Procedures) 28 ประเด็น ในเอเชียมีผู้รายงานพิเศษติดตามสถานการณ์ในประเทศอยู่ 3 ประเทศ คือ พม่า เกาหลีเหนือ และกัมพูชา โดยผู้รายงานพิเศษเหล่านี้สามารถรับข้อมูลการละเมิดสิทธิมนุษยชนจากผู้ถูกละเมิด องค์กรสิทธิมนุษยชน ได้โดยตรงและจะมีหน้าที่ในการคำร้องเรียน (urgent appeal) ถึงรัฐบาลต่าง ๆ นอกจากนี้ยังมีการสามารถเข้าไปตรวจสอบสถานการณ์สิทธิมนุษยชนในประเทศนั้น ๆ ได้ แต่สำหรับกรณีพม่า รัฐบาลทหารพม่าปฎิเสธที่จะให้ศาสตราจารย์พอลโล เซอร์จีโอ พินเฮโร ผู้ตรวจสอบฯ กรณีสิทธิมนุษยชนในพม่าเข้าไปตรวจสอบตั้งแต่ปี ค.ศ. 2003 เป็นต้นมา

ในประเทศไทย ผู้รายงานพิเศษกรณีนักปกป้องสิทธิมนุษยชน (Special Representative on the UN Secretary-General on Human Rights Defenders) ได้เดินทางมาตรวจสอบสถานการณ์กรณีการละเมิดสิทธินักปกป้องสิทธิมนุษยชนในปี ค.ศ. 2003
